Most parents would do anything for their children. Their child’s safety is the most important thing to them and they will take every possible measure to keep their children out of harms way. Child Care facilities are required by law to take the following steps to prevent child porch injuries. If a daycare fails to follow these rules and your child gets hurt then you can bring a claim for damages against the negligent daycare:

(a) Porches and decks that are more than three feet from grade level must be surrounded by a protective barricade in accordance with applicable building codes.

(b) Barricades must be sturdy and constructed in a way that will prevent a young child from going underneath, over, or through them.

(c) Stairs must be safely barricaded whenever the porch or deck is in use by children younger than three years old.

(d) Additional precautions may be required as deemed necessary.

(e) Porches and decks must be inspected and approved by the Department before use by child care children.

(f) Porches and decks may be used to meet the requirements for outdoor play space.
