Under Massachusetts General Laws Chapter 94C Section 32G it is a crime to knowingly or intentionally create, distribute, dispense, or possess with intent to distribute a counterfeit substance. A “counterfeit substance” is anything that is passed-off as being one drug when it is in fact not that drug.
Counterfeit drugs are really fake drugs that appear similar to real drugs. In order to get a conviction for distributing counterfeit drugs the prosecution has to show that the defendant knew the drugs were counterfeit and distributed them anyway. Often times the prosecutor will have to use circumstantial evidence to prove the defendant knew the drugs were counterfeit. If there is evidence that the defendant made the drugs or made statements to an undercover officer to the effect the he knew the drugs were counterfeit than this might support a conviction.
Possession of counterfeit drugs is a serious crime and the Commonwealth will dedicate great time and expense in prosecuting this offense. A conviction for possession of counterfeiting drugs doesn’t require minimum prison terms like most other drug crimes in Massachusetts.
