Massachusetts General Laws Chapter 94C Section 32E governs the drug trafficking laws in Massachusetts. State officials in Massachusetts consider drug trafficking as the most serious drug crime and as a result the law imposes severe penalties for a conviction. In addition to proving drug possession the prosecutor, in order to obtain a conviction for drug trafficking, must show that defendant knowingly possessed, distributed, manufactured, or cultivated a certain amount of drugs. Different drugs require different quantities in order for a trafficking charge to stick.

Criminal Penalties For Drug Trafficking – Marijuana

  • A conviction for Less than 100 pounds but more than 50 pounds of marijuana results in a minimum imprisonment of 1 year up to a maximum of 15 years in a state prison.
  • A conviction for Less than 2,000 pounds but more than 100 pounds of marijuana results in a minimum imprisonment of 3 years up to a maximum of 15 years in a state prison.
  • A conviction for Less than 2,000 pounds but more than 1,000 pounds of marijuana results in a minimum imprisonment of 5 years up to a maximum of 15 years in a state prison.
  • A conviction for 10,000 pounds or more of marijuana results in a minimum imprisonment of 15 years up to a maximum of 15 years in a state prison.

Criminal Penalties For Drug Trafficking – Class B Narcotics Including Cocaine

  • A conviction for Less than 28 grams but more than 14 grams of cocaine results in a minimum imprisonment of 3 years up to a maximum of 15 years in a state prison.
  • A conviction for Less than 100 grams but more than 28 grams of cocaine results in a minimum imprisonment of 5 years up to a maximum of 20 years in a state prison.
  • A conviction for Less than 200 grams but more than 100 grams of cocaine results in a minimum imprisonment of 10 years up to a maximum of 15 years in a state prison.
  • A conviction for 200 grams or more of cocaine results in a minimum imprisonment of 15 years up to a maximum of 20 years in a state prison.

Drug Trafficking – Heroin, Morphine Salts, Opium Salts

  • A conviction for Less than 28 grams but more than 14 grams of heroin results in a minimum imprisonment of 5 years up to a maximum of 20 years in a state prison.
  • A conviction for Less than 100 grams but more than 28 grams of heroin results in a minimum imprisonment of 7 years up to a maximum of 20 years in a state prison.
  • A conviction for Less than 200 grams but more than 100 grams of heroin results in a minimum imprisonment of 10 years up to a maximum of 20 years in a state prison.
  • A conviction for 200 grams or more of heroin results in a minimum imprisonment of 15 years up to a maximum of 20 years in a state prison.
