The U.S. Labor Department reports that 50 percent of the elevator-related fatalities that occur every year occur during repair or maintenance or when people use elevators to get to and from work. Of the elevator related deaths occurring in residential buildings (i.e., condos or apartments) 50 percent were the result of falls in the elevator shaft while the other 50 percent occurred when passengers got caught and crushed between the elevator and the wall of the elevator shaft.
Elevators accidents have many causes. The following have led to passenger deaths:

  • Pulley system malfunctions, or other defect causing an elevator to drop too fast within the shaft;
  • Open shaft which allows passengers to fall;
  • Faulty wiring creating risk of electrocution;
  • Incomplete or faulty repairs, maintenance, or inspections;
  • Unbalanced leveling or failure to line up the elevator with the floor;
  • Improper installation.

Elevator manufacturers, business and building owners, and elevator maintenance companies have a duty to ensure that elevators are properly installed, maintained and inspected. If they fail to perform thorough inspections or maintain the elevators up to code then they can responsible for injuries sustained to passengers.
