Internet Sex Crime Defense LawyerThe Serious Nature of Internet Sex Crimes

Internet sex crimes involve complicated and technical issues to be thoroughly investigated by an experienced criminal defense attorney. Two issues that we will initially investigate include whether or not there are other users of the computer in question and the nature of the conduct by investigators.

With an experienced criminal defense attorney, you may be able to put the prosecution on the defensive by pointing out groundless assumptions, questionable actions performed by law enforcement and inappropriate circumstantial evidence.

Internet Chat Room Sting Operations

Massachusetts law enforcement uses a wide variety of web-based resources to attract, identify and pursue Internet sex crimes perpetrators.  They most aggressively seek to identify child molesters, but also use sting operations to offer fake “escort” and other sexual services to adults seeking adults.  However, police sting operations sometimes amount to entrapment or may even falsely identify innocent people as being sex offenders.

What the Police Are Allowed to Do

Massachusetts law officials, along with federal law enforcement officers, run hundreds of sting operations by entering chatrooms and posing as purveyors of illicit child pornography. They also will pose as minor children that are interested in having sex with adults. Law enforcement officers posing as minors may even ask if they can send pornographic images or ask adults to send them pictures. Law enforcement officers may even pose as minors interested in having sex with an adult. Once an adult sends the illegal images or the adult agrees to meet with someone whom they believe is a minor, investigators record their IP address and begin an investigation.

Police are allowed to enter chat rooms posing as children or underaged teens, or place ads on social networking sites, or advertising services (i.e., Craig’s List) suggesting the offer of sexual favors or prostitution.  They are allowed to set up fake meetings where the alleged perpetrator shows up thinking they will be meeting with a minor, or adult with the intention of engaging in some sort of sex act or sexual transaction.

What police are not allowed to do is entrap someone.

Anyone seeking, willing and ready to break the law, and who is caught in a police sting operation is not a victim of entrapment.  However, a  person who is induced or persuaded by law enforcement officers or their agents to commit a crime that he had no previous intent to commit may be considered a victim of police entrapment.
