In order to prove the offense of operating without a license the commonwealth will have to show the following:

  • The defendant operated a motor vehicle;
  • The defendant operated a motor vehicle on a public way; and
  • The defendant operated the motor vehicle without having a valid license.

The legal definition of “operation” is any intentional manipulation of some mechanical or electrical part of the vehicle — like the gear shift or the ignition — which, alone or in sequence, will set the vehicle in motion.
