The state of Massachusetts has some of the strictest, and most complicated, gun laws in the entire U.S., and imposes severe penalties on people caught illegally possessing firearms, as well as for  any type of controlled deadly weapon.

If you have any gun or rifle in your possession you must have a Firearms Identification (FID) card for the weapon. Failure to produce and FID card when asked to by the police could expose you a to a minimum jail term of 18 months. The likelihood of receiving this stiff penalty increases when it can be proved that you obtained your weapon illegally, rather than carelessly leaving your FID card at home.

Because possessing, or not possessing, a valid FID card is usually a clear, open-or-shut matter, many cases involving the possession of illegal firearms possession boil down to whether or not you were a victim of an illegal search and seizure by the police. A police officer is generally not allowed to stop you for a traffic offense and then, without any reasonable suspicion, search the interior of your car, nor is he allowed to stop and frisk you randomly on the street. Mistaken Ownership; Someone Else Concealed a Weapon

Carrying a Concealed Weapon

In Massachusetts, you must have a Class A License to Carry a concealed weapon. A Class A Licenses allows the gun owner to carry either a handgun or long gun without a limit on the magazine size. If you conceal a weapon, and only have a Class B License to Carry, you may own a handgun that has a capacity of ten rounds or less or own a long gun that holds any size magazine, but you may not carry and conceal them.

Filing a False Application for Gun Ownership

Massachusetts law prohibits certain individuals from owning a gun. If you attempt to falsify information to obtain an FID card, you have committed a crime. “Any person who knowingly files an application containing false information shall be punished by a fine of not less than $500 nor more than $1,000 or by imprisonment for not less than six months nor more than two years in a house of correction, or by both such fine and imprisonment.”
