Boston Prescription Drug Fraud Defense Attorneys

Over the years state and local police in Massachusetts have made a point to enforce prescription drug laws. The penalties for illegally possessing or distributing Oxycontin, Percocet, Vicodin, and other prescription drugs have increased dramatically over the years. Illegal prescription use is very common these days. Pain killers are more addictive than most drugs and often times using these drugs for legitimate purposes can create a dependence that leads to illegal use and prescription fraud. Violators of the prescription drug laws include patients, doctors, nurses and pharmacists.

Forgery usually deals with creating a false document or alternating a genuine document in order to make it false for the purpose of defrauding. Uttering deals with passing off the forged document as a real one with the intent to defraud. Almost any document can be forged and uttered. However checks and prescriptions are the documents that are most commonly forged. Someone can be charged with forging a false prescription even if they didn’t utter it and someone can be charged with uttering a prescription even if they didn’t forge it.

Types Of Prescription Drug Fraud Crimes

Prescription drug crime comes in many forms.  The following are some of the forms prescription drug fraud takes:

  • Forging Prescriptions: Copying a valid prescription, or creating a prescription that looks like a real prescription a doctor might use and then filling it out, signing it and submitting it to a pharmacy.
  • Altering Prescriptions: Changing a genuine prescription a doctor filled out and signed by altering the type of drug, increasing the dosage or amount of pills per fill, adding or increasing the number of refills, writing other drugs on the prescription or changing the name of the person on the prescription.
  • Multiple Doctors: Visiting several different doctors or health care providers and having them all prescribe prescription drugs.
  • Calling-In Refills Prescriptions: Taking someone’s prescription bottle and calling the pharmacy impersonating that person in order to have prescription refilled or impersonating a medical provider and calling in a false prescription.
  • Stealing Prescription Forms: Visiting a doctor’s office and stealing prescription pads and then filing them out and then trying to fill them.

If found guilty the defendant could face to up to 2 ½ years in jail, or 8 years in state prison, and/or a fine of $30,000.
