The unlawful possession of a loaded firearm is a crime that is separate from unlawful possession of a firearm or unlawful possession of a large capacity weapon. If a defendant is convicted for unlawful possession of a loaded firearm they will also be convicted of unlawful possession of a firearm.

Possession of a firearm and possession of a loaded firearm are two separate crimes. As a result a conviction for both crimes will result in separate penalties. The additional penalty for carrying a loaded firearm will result in a sentence of no more than 2 ½ years in the house of corrections.

  • The defendant possessed a firearm;
  • The firearm met the legal definition of a firearm;
  • The knew he was in possession of the firearm;
  • The firearm was loaded.

A firearm is pistol, revolver, or other weapon, whether loaded or unloaded, which has a barrel length of less than 16 inches from which a shot or bullet can be discharged.

In Massachusetts, a firearm is considered loaded when ammunition is contained in the weapon or within a feeding device (magazine or clip) attached to the weapon.
